Terms of Service

AnchorFox offers software and related services designed to help schools, boat clubs, sailing co-ops, and similar organizations operate their programs. The features, pricing, and availability of the Services may change from time to time.

If you create an account, you agree to provide accurate and complete information and to keep it up to date. You are responsible for safeguarding your credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

You agree not to:

• Use the Services in violation of any law or regulation.
• Infringe the rights of any third party or upload content you do not have the right to share.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Services or any related systems.
• Probe, scan, reverse engineer, or test the vulnerability of the Services except as expressly authorized.
• Use the Services to send spam, malware, or other harmful or deceptive content.
• Resell, sublicense, or otherwise commercially exploit the Services without our permission.

You retain ownership of the content you submit to the Services. You grant AnchorFox a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for technical purposes such as formatting), and display your content as necessary to operate and improve the Services. You are responsible for your content and for ensuring you have the rights to share it with us.

The Services, including all software, branding, content, and documentation we provide, are owned by AnchorFox or our licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Services for their intended purpose. All rights not expressly granted are reserved.

The Services may link to or integrate with third-party websites, applications, or services that we do not control. We are not responsible for the availability, content, or practices of those third parties. Your use of them is governed by their own terms and privacy policies.

If any portion of the Services requires payment, the applicable fees, billing cycles, and payment terms will be described at the point of purchase or in a separate order. Fees are non-refundable except as required by law or expressly stated otherwise.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. ANCHORFOX DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANCHORFOX AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR THE SERVICES IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS.

You agree to indemnify and hold harmless AnchorFox and its affiliates, officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your content, or your violation of these Terms or applicable law.

We may suspend or terminate your access to the Services at any time, with or without notice, including if we believe you have violated these Terms. You may stop using the Services at any time. Sections intended by their nature to survive termination will continue to apply.

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the United States and the State of California, without regard to conflict-of-laws principles. Any disputes arising out of or related to these Terms or the Services will be resolved exclusively in the state or federal courts located in San Francisco, California, and you consent to personal jurisdiction and venue there.
